Summary of the Bill:
Modification of Law 20,630:
Article 1:
Prizes subject to tax: These include prizes won in raffles, lotteries, raffles and sports betting contests (except horse racing), organized in the country by official or private entities with authorization.
Exclusions: Prizes from Quiniela and Casino games (official gaming rooms) are not taxed, nor are prizes that remain in the possession of the organizing entity due to the absence of third-party beneficiaries.
Article 5:
Exemptions: Prizes whose net amount does not exceed $1,600,000 are exempt from tax. This amount will be updated annually according to the wholesale price index provided by INDEC.
Fundamentals of the Modification:
Clarification: The wording of Article 1 of the original law was confusing and led to judicial decisions to interpret it correctly. The modification seeks to make the law clearer and easier to apply.
Updated Exempt Amount: The original exempt amount ($1,200 in 2003) was not updated properly, causing inconvenience among bettors.
It is proposed to update the amount to $1,600,000 and adjust it annually to avoid updating due to inflation.
Influence of the Economy: To maintain the relevance of the exempt amount in the face of inflation, an update coefficient is included based on national economic indices.
Requests and Support:
Reasoning: The modification takes into account both legislative clarity and economic updating, seeking to avoid future problems.
Request for Approval: Representative Marcela Campagnoli asks her colleagues to support and approve the bill, based on the need for clear and updated legislation.
These are the most notable points of the Bill that proposes to modify articles 1 and 5 of Law 20,630, adjusting and clarifying the regulations on taxable and exempt prizes in games and betting in the country.
