Zona de Azar Brasil – Brasil: STF Prohibits Advertising to Children and Limits Betting
Brazil – November 15, 2024 www.zonadeazar.com Minister Luiz Fux of the Federal Supreme Court (STF) ordered this Wednesday (12) that the federal government adopt “special protection” measures to prohibit beneficiaries of social programs, such as Bolsa Família and the Continuous Cash Benefit (BPC), from using resources to place online bets.
Additionally, Fux also established that the rules set forth in a federal government decree prohibiting betting site advertisements aimed at children and teenagers must be immediately enforced.
“It is evident that the current scenario of insufficient protection, with immediate harmful effects, particularly on children, adolescents, and the family budgets of welfare program beneficiaries, constitutes clear periculum in mora (danger in delay),” the minister said.
Experts consulted by Lei em Campo state that sports betting has become a social problem in Brazil, and therefore an intense debate on the topic and better regulation of the sector is needed. “The sports betting law was passed without major debates on the consequences for the ‘public health’ of society.
Amid so many social injustices afflicting the country, with a shortage of resources for the population, and high unemployment, a false ‘premise’ of easy money was created, leading those in greater vulnerability to bet their scarce money on sports betting, creating a certain psychological ‘dependency’ commonly found in gambling. It is no coincidence that bingos were banned and casinos are prohibited in Brazil,” says sports lawyer Leonardo Laporta.
“However, the Union’s interest in collecting part of this revenue has overridden the concern for social education on the unrestricted and indiscriminate use of this new harm, which is causing serious problems in the family environment of many Brazilians, with repercussions across several sectors of society, such as supermarkets and consumer goods, even impacting religious entities that are also noticing a decrease in tithes and donations. It is urgent and extremely necessary to have a more intense debate on the topic and better regulation of the issue,” he adds.
