The Prizes and Bets Secretariat of the Ministry of Finance published, this Wednesday (31/07), Ordinance SPA/MF No. 1,212/2024 which establishes how betting operators must collect the amounts from the social allocations of this lottery modality. Like every lottery in Brazil, part of the proceeds must have a social function. In the fixed-odd lottery betting modality, the legislation establishes the areas of health, education, sport, social security, industrial development, tourism and public security as beneficiaries.
The Ordinance provides specific rules to guide companies on how to collect the amounts provided for in § 1-A of article 30 of Law No. 13,756/2018, which was amended by Law 14,790/2024, into the Union’s coffers. At this first moment, the collection codes were specified for the amounts to be transferred to the National Treasury, through a Federal Revenue Collection Document (DARF).
According to the new standard in the regulatory framework for the fixed-odd lottery betting modality, the betting operating agent who does not pass on the revenues foreseen for social allocation will be subject to civil, administrative and criminal liability. He must keep proof of transfers to the Treasury and legal beneficiaries at the disposal of the SPA for a period of five years.
In the case of prescribed prizes, in which the bettor loses the right to receive the prize or to request a refund, the amounts will be collected into the Single Treasury Account. Operators will have to produce monthly accountability reports, which will be monitored by SPA. The rules established by the ordinance will be applied from January 1, 2025.
