Zona de Azar Brasil – Brazil: Proposal Seeks to Prohibit Child-Related Elements in Online Betting

Brazil.- November 28, 2024 www.zonadeazar.com A new bill introduced in the Senate aims to prohibit commercial strategies that could attract children and teenagers to online betting platforms. Bill PL 4,390/2024, authored by Senator Eduardo Girão (NOVO-CE), proposes changes to the sports betting regulation law (Law 14,790 of 2023) to ban the use of child characters, cartoons, and infantilized language on these companies’ digital channels.

The penalties include fines ranging from R$ 1 million to R$ 5 million per violation, temporary suspension of operations for up to 180 days, and revocation of authorization in cases of repeat offenses. The project’s goal is to strengthen the protection of children and adolescents in the digital environment.

Girão argues that many websites and apps have deliberately used strategies to attract children and teenagers to betting activities, exposing them to inappropriate content.

“These measures aim not only to punish offenders but primarily to prevent the exposure of children and adolescents to content that exploits their vulnerability for profit. The Federal Constitution establishes that it is the duty of the family, society, and the State to protect children and adolescents from all forms of neglect and exploitation,” he states in the justification for the bill.

The senator also notes that, although he opposes the legalization of online betting due to its associated negative impacts, he considers it important to establish stricter rules to minimize social harm.

The matter is currently under review by the Commission for Communication and Digital Law (CCDD), awaiting amendments and the appointment of a rapporteur. Once voted on, it will proceed to final analysis in the Commission for Constitution and Justice (CCJ).
