Zona de Azar Brasil – Brazil: Rejected Loterj’s Request to Take Down Betting Sites

Brazil.- May 14, 2024 www.zonadeazar.com Judge Mateus Pontalti, from the 13th Federal Civil Court of the Judiciary Section of the Federal District, rejected the request from Loterj, the Rio de Janeiro Government body responsible for managing the State’s lotteries , which requested a court order ordering Anatel to take down betting sites that have not obtained a state license. Joga Brasil obtained a first-hand copy of the decision.

Among the justifications, the judge claimed that “Loterj does not have the authority to require internet application providers and ISP companies to block electronic websites or applications” (…) and “that such a measure can only be implemented upon request of the Ministry of Finance”. According to the decision, by refusing to transmit the blocking order to content providers, Anatel “acted in accordance with current legislation”.

In the initial petition, Loterj claimed that 13 companies are already accredited in the state and “operating within the law”, while the remaining sports betting houses that are operating without licensing and without paying taxes would be “unfair competition” to those that are regulated.
