Zona de Azar Brazil – Brazil: CLARO Informs TRF1 that it does not have the Technical Conditions to Block Websites

Brazil.- July 26, 2024 www.zonadeazar.com  Through an official letter, the telephone operator Claro reported to ANATEL that it would not be possible to block websites without authorization from the Rio de Janeiro State Lottery – LOTERJ only within the limits of the State of Rio de Janeiro due to the format of its network structure (mobile and fixed) being centralized, which would imply restricting access to websites throughout the country.

The operator also filed a petition with the judge of the Federal Regional Court of the First Region, Pablo Zuniga Dourado, informing about the impossibility of complying with the order received in the way it was formulated, especially due to the technical limitations faced and supported by the infrastructure of the telecommunications network operated by CLARO.

“CLARO clarifies that there is no way to delimit the intended blocking of the State of Rio de Janeiro, due to technical issues and systemic aspects, which must, which is considered with due respect and compliance, become the object of scrutiny and evaluation by this judging body”, it states. The operator also informs that compliance with the measure will result in the suspension of accesses throughout the national territory, in relation to its fixed network, and in a significant portion of the national territory, in relation to its mobile network.

In technical terms, CLARO currently uses two DNS2 clusters for its entire mobile network. The cluster that serves the State of Rio de Janeiro also serves the States of Minas Gerais, Espírito Santo and the Central-West, Northeast and North regions of the country, which would cause access interruption for all users in this group. On the other hand, the equipment that provides the DNS IP used by CLARO is the PGW3 (Packet Gateway), which connects the mobile network to the Internet, which in addition to serving the State of Rio de Janeiro also serves Espírito Santo, as well as all cities that use satellite transmission technology, which would be impacted by the forced interruption.

In addition to the clarifications, CLARO made itself available to the judicial authority so that, through a hearing with its lawyers and technicians, it could clarify any points of interest that the judge considers necessary to understand the particularities and limitations of the networks operated by the company, especially to assess the requests for reconsideration formalized within the scope of the declaration of opposition.

The operator reaffirms its commitment to the Judiciary, and that it has never voluntarily opposed compliance with a court order and the request formalized by ANATEL, having only pointed out the limitations to compliance with the decision, dismissing any allegation of disobedience.

AT&T Global Network Services Brazil also reported the impossibility

In addition to Claro, AT&T Global Network Services Brazil, a provider of voice, video, data and Internet telecommunications services for companies, individuals and government agencies, also informed TRF1 that, due to technical and technological issues, it is not possible to restrict the blocking of websites to the State of Rio de Janeiro. The operator AT&T clarified that if the requested blocking is implemented, it will be carried out throughout the national territory.
