In response, Conar (National Council for Advertising Self-Regulation) reinforced its commitment to promoting responsible and ethical advertising in the iGaming and sports betting sector.
Conar advocates for self-regulation, allowing betting companies to create their campaigns as long as they follow ethical guidelines, avoiding the need for judicial interventions.
Conar and Social Protection in Betting Advertising
In the statement, Conar refers to Annex X, a set of rules issued in December 2023 by the entity itself. This document aims to:
- Ensure socially responsible advertising in the sports betting sector
- Respect the safety of the betting environment
- Protect children, adolescents, and vulnerable individuals
Thus, the Annex X proposal seeks to establish a standard for betting advertising in line with regulatory commitments.
“Annex X aimed to meet the legislator’s incentives for advertising self-regulation and respond to commitments made to the competent public authority,” stated Conar.
The guidelines include modern protection mechanisms, such as age-targeting tools and the prohibition of advertising in child- and youth-oriented content.
The statement also emphasized the protection mechanisms to prevent children and adolescents from being impacted by betting campaigns. Key rules include:
- Using tools to limit advertising reach based on age
- Prohibiting campaigns in child- and youth-directed content
- Preventing individuals under 21 from participating in advertising campaigns
Since implementing Annex X, Conar has initiated around 60 cases against betting advertising campaigns to evaluate their compliance with the established norms. Half of these cases have been judged, resulting in actions like altering or suspending campaigns when necessary.
Despite the betting sector’s novelty, Conar expects it to foster a responsible advertising environment.
Prohibited Advertising for Young Audiences
Conar’s statement follows a ban from Senacom (National Consumer Secretariat) under the Ministry of Justice on betting ads targeting children and adolescents. The measure reflects concerns about protecting young audiences amidst the rise of online betting in Brazil.
Betting platforms have ten days to submit a detailed report on actions to comply with the new rules. Noncompliance will result in a daily fine of R$ 50,000.
The government and regulatory bodies aim to strengthen oversight to ensure ethical and safe development of the betting sector in Brazil, prioritizing consumer protection, particularly for youth.
The goal is to create an environment where sports betting can coexist with safety and individual well-being, safeguarding future generations’ integrity.
