The mayor of Ribeirão Preto, Duarte Nogueira (PSDB), vetoed last week the bill approved by the City Council that authorized the creation of a public municipal lottery service. The proposal had been approved by the City Council on March 26.
At the time, the substitute for PL 155/2022 obtained 15 votes in favor and two against. The proposal aimed to raise resources for social security and finance projects in various departments.
When vetoing the bill, Duarte Nogueira pointed out the unconstitutionality of the proposal that authorizes the creation of a lottery in the city and that the Federal Constitution limits the exploration of “consortium and lottery systems” to the Union. Furthermore, he recalled that the STF. (Federal Supreme Court), understood that only states, and not municipalities, could also explore these services.
“The bill was careful not to innovate legislatively regarding consortia and raffles, but it still suffers from unconstitutionality, since it seeks to adapt federal legislation to the provision of lottery services in the municipality of Ribeirão Preto,” the justification states.
Now, the mayor’s veto was presented to the Legislature, and must be analyzed by the House and plenary commissions, which can accept the veto or revoke it.
