The bank uses technology to identify Pix keys frequently associated with betting platforms. Before completing the transaction, it sends messages encouraging customers to reconsider their use of the funds.

When a Pix key identified as potentially linked to a betting house is entered, the initial message asks: “Is this transfer for a betting house? The entered Pix key is frequently used by betting houses.”

If the customer confirms, a new message appears: “How about saving this money? Some of these games are legalized in Brazil, but there are no guarantees of winning. By saving this money instead of betting, you ensure it will grow without worry.”

Despite the warnings, Nubank does not block the transaction. The institution stated that the alerts do not appear for all customers and did not disclose the criteria used to identify Pix keys linked to betting houses.

ANJL and Industry Associations Respond with Condemnation

Nubank’s initiative sparked strong reactions from Brazil’s leading betting industry associations, including ANJL (National Association of Games and Lotteries), AIGAMING, and ABRAJOGOS. In a joint statement, the organizations condemned the action, labeling it discriminatory and harmful to economic freedom.

“The betting industry is legalized in Brazil under Laws No. 14.790/2023 and 13.756/2018 and regulated by the Ministries of Finance and Sports. By adopting this practice, Nubank positions itself against an activity recognized by Brazilian legislation,” said ANJL President Plínio Lemos Jorge.

The associations also criticized the bank’s lack of consistency, noting that similar alerts are not issued for spending on items like alcohol and cigarettes. Moreover, they pointed out that the action does not target illegal betting sites, which they argue exacerbates the problem by failing to encourage consumers to migrate to regulated operators.

Betting in Brazil: A Growing Market

Brazil leads the world in access to online betting platforms, with 6.68 billion visits in 2024, according to Aposta Legal. The recently regulated market requires companies to use “.bet.br” domains and comply with strict operating standards.

The federal government expects regulation to address structural issues, including predatory practices and over-indebtedness. However, the associations argue that strengthening the market should involve incentives and combating illegal operators, rather than actions they claim misinform consumers.

The controversy between Nubank and the betting sector sparks debate over the limits of financial institutions’ roles. It highlights critical tensions between private sector policies and regulated activities, raising questions about the balance between economic freedom and social responsibility.

As the debate unfolds, the betting market continues to generate billions, challenging businesses and regulators to find fair and effective ways to coexist.
