Peru.- November 5, 2024 www.zonadeazar.com By November 15, all Sports Betting and Online Gaming operations must be authorized, homologated, and registered.

Nicolas Samohod Rivarola, Director at Vidal Cáceres Abogados in Lima, Peru, with extensive experience in Corporate Law and gaming management, reminds us that November 15 is the final deadline granted by the Peruvian regulatory body MINCETUR for all operations in the local Sports Betting and Online Gaming market to be authorized, homologated, and registered, meaning formalized, as stipulated by Law No. 31557 (2022), amended by Law No. 31806 (2023) and regulated by Supreme Decree No. 005-2023-MINCETUR.

From that date, inspections and administrative penalties by the MINCETUR regulator will begin.

“In the case of the PLATFORMS for Sports Betting and/or Online Gaming,” adds Dr. Samohod, “one of the requirements is to have the GUARANTEE (BANK GUARANTEE OR SURETY BOND) provided for in Articles 22 and 24 of Law No. 31557, whose Regulation, approved by Supreme Decree No. 005-2023-MINCETUR, establishes in Article 12 that:

“The holder of the exploitation of Technological Platforms (for Sports Betting and Online Gaming) is obliged, as a prerequisite for the start of operations of the exploitation of the Technological Platform and/or the opening of the Sports Betting room, to provide the guarantee provided for in Articles 22 and 24 of the Law and to deliver it to MINCETUR, under the warning of incurring in administrative violation, among other regulatory obligations.” Source
