Operators have 45 days to display clear warnings on their platforms
The Federal Court of São Paulo has ruled that all online betting platforms must include visible warnings prohibiting the use of government aid, such as Bolsa Família and the BPC (Continuous Cash Benefit), for gambling.
Penalty of R$ 500,000 per day for non-compliance
The ruling, signed by Judge Gabriel Hillen Albernaz Andrade, requires all platforms to implement warnings across all user interfaces within 45 days. Failure to comply will result in a daily fine of R$ 500,000.
NGOs call for stricter controls, but court denies requests
Several NGOs requested the sharing of Bolsa Família recipients’ tax IDs (CPF) with betting sites to block registrations, as well as a ban on ads targeting low-income users. The judge denied both requests, calling them invasive and disproportionate.
Protecting vulnerable families without excessive censorship
The injunction aims to protect financially vulnerable families while preserving the right to information. The judge concluded that there was no evidence of abusive or misleading advertising in current betting promotions.
