Brazil: Public Consultation on the Regulation of the Capixaba Lottery

Brazil – June 4, 2025 | www.zonadeazar.com — The Espírito Santo State Public Services Regulatory Agency (ARSP) has opened a public consultation this Monday, June 2nd, to develop the resolution that will establish the general conditions for the state lottery services. This process marks a significant step towards implementing the Capixaba Lottery.
The consultation aims to gather input from industry experts, regulatory bodies, private companies, and other stakeholders. The deadline to submit suggestions is June 30, 2025. This initiative seeks to build a regulatory framework in a participatory, transparent, and best-practice-driven manner.
Tatiana Oliveira, Director of Lottery at ARSP, emphasized: “This is a crucial step to ensure that the regulation of the Capixaba Lottery is built transparently and democratically, following industry best practices. We want to listen to society and experts to develop a robust regulatory framework that ensures efficiency, integrity, and social responsibility in the operation of the state lottery.”
Legal Framework of the Capixaba Lottery
The Capixaba Lottery’s legal foundation designates Banestes as the operator of the legalized modalities and ARSP as the regulatory authority. This action is part of ARSP’s 2025/2027 Regulatory Agenda and follows the guidelines of Complementary Law 1,069/2023, which governs the state lottery service. Additionally, Decree 5,931-R/2025 outlines ARSP’s responsibilities, including issuing complementary regulations, overseeing the lottery plan, and implementing measures to prevent gambling addiction.
How to Participate
The electronic submission form is available on the ARSP website and covers key topics such as technical requirements, risks, governance, transparency, innovation, and other relevant points to ensure proper regulation. Both individuals and legal entities can participate in the public consultation until 11:59 p.m. on June 30, 2025.
After the deadline, the ARSP’s Lottery Regulation Working Group will carefully analyze all received contributions. These inputs will form the basis for drafting the resolution that will govern the operation of the Capixaba Lottery. ARSP will then publish a consolidated report with all submitted proposals on its official website, including the names of the contributors and their proposals, while ensuring the confidentiality of sensitive personal data.
Through this participatory process, the agency aims to identify specific needs and strengthen existing control mechanisms, thereby significantly enhancing public trust in this new state lottery service.
It is worth noting that the public consultation is supported by Article 18, paragraph 3, of Complementary Law No. 827/2016, as well as Article 69, item I, of ARSP Resolution No. 071/2024. The main goal is to gather high-quality input to draft the resolution that will regulate the lottery services in Espírito Santo.
