Brazil: Secretariat of Prizes and Betting Expands Inquiry Options

It is now possible to access more detailed information about promotions, including those already authorized and those under review. This information comes from the Secretariat of Prizes and Betting of the Ministry of Finance (SPA-MF). This new inquiry option will make the process more transparent for society.

Commercial promotions—defined as the free distribution of prizes for advertising purposes—are governed by Law 5,768/1971. These are actions carried out by companies that sell goods or services to boost their sales, such as promotions and the disclosure of special prizes, including by betting houses.

Additionally, philanthropic entities may hold raffles involving donated goods, with the proceeds from ticket sales used to cover the entity’s operating expenses.

According to the legislation, it is the responsibility of the federal government to authorize and oversee commercial promotions in Brazil. Since its creation in January 2024, the SPA has been responsible for this task.

SCPC has been operational since 2019

Since 2019, the authorization processes for commercial promotions have already been available through the SCPC. Public inquiries conducted on the SCPC website previously returned only a limited set of data, all displayed in HTML format.

From now on, a broader set of public data on commercial promotions will be displayed. Additionally, the system now allows users to extract this data in CSV format or connect to it via an Application Programming Interface (API).

This measure aims to facilitate data inquiries and processing, both to increase the social transparency of information and to enable market operators to conduct more accurate business opportunity assessments.
