The decision issued on September 29 was based on a Recurso de Protección (constitutional protection proceeding), in which the operating platforms were not parties. Thus, according to Baeza, companies cannot be bound by measures that exceed the specific scope of the ruling.

The court ordered telecom providers to block a group of specific URLs deemed illegal under Chilean law, but the decision does not create broad regulatory guidelines nor impose requirements on operators not implicated.

The ruling demands blocking of twelve particular URLs involved in unauthorized betting. Baeza argues that the directive is limited solely to those sites and does not affect other platforms not named in the judgment.

He emphasized that the proceeding is procedural and circumscribed: since the platforms were not included in the litigation, they cannot be judged by provisions outside their case.

Future Outlook

Baeza insists that the sustainable path is to pass a comprehensive law that legitimizes online gambling in Chile. Domain blocking is a tactical remedy but ineffective long term, as operators can circumvent blocks by changing addresses.

Therefore, the bill advancing in the Senate gains importance: without clear regulation, operators remain under legal uncertainty. Baeza believes regulatory clarity is essential to stabilize the industry and avoid fragmented litigation.
