Chile Lacks Formal Online Betting Licenses; Regulation Bill Progresses

Current Legal Framework

The Superintendencia de Casinos de Juego (SCJ) currently regulates only land-based casinos under Law No. 19.995 (2005). There is no legal basis for issuing licenses to online gaming or betting operators, leaving the digital segment in a regulatory void that permits offshore platforms to serve local users without specific domestic oversight.

A regulatory bill before the Chilean Parliament seeks to introduce licensing and supervision for online casinos and sports betting, including operational requirements, compliance standards, player protection mechanisms and tax obligations — but it has not yet been enacted.

Competition and Player Protection

The absence of an online license framework creates an uneven playing field compared to authorised land-based operators and raises concerns about consumer protection, anti-money-laundering controls and competitive integrity.

Industry stakeholders argue that formal online regulation would bring legal clarity, foster investment, and elevate compliance standards, yet its delay prolongs uncertainty for the digital market’s development.

Market Outlook

If enacted, a licensing regime for online operators could position Chile as a regulated iGaming market in Latin America with defined operator rules and responsible gaming standards. For now, online betting continues without formal licensing — despite rising demand and growth in offshore offerings.
