Brazil: State-Licensed Betting Sites Generate BRL 15.4 Million and Expose Legal Gaps

The findings reveal a regulatory loophole: the absence of effective geolocation controls limiting bets to the territory where the license was issued. In theory, platforms authorized by states such as Rio de Janeiro or Paraíba should only operate within those jurisdictions.

In practice, 87% of state-licensed websites remain accessible nationwide, contradicting the territorial restrictions set by Federal Law 14.790/2023.

Popular sites like Bet Fácil and MajorSports, licensed by Loterj, recorded over 15 million visits between July and September—numbers suggesting not only local popularity but also potential access by players outside the state, a violation of current regulations.

According to Aposta Legal’s estimates, the activity of these sites may represent up to BRL 2 million in lost federal tax revenue, due to a lack of territorial enforcement.

Legal framework and regulatory conflict

Recent rulings by the Supreme Federal Court (STF) have allowed the same economic group to operate lotteries in multiple states and advertise nationally, deepening the legal ambiguity between state autonomy and federal oversight.

Meanwhile, Loterj removed the geolocation requirement from its latest notice, enabling access from any region of the country.

Consumer risk

This lack of regulatory clarity poses serious risks to players: those betting from outside a licensed state lose legal protection in case of unpaid prizes or blocked accounts.

The scenario underscores the urgent need for coordination between state and federal authorities to close existing legal gaps and ensure fair competition and player safety.
