Brazil – March 6, 2025 www.zonadeazar.com Flavio Jaime de Moraes Jardim, judge of the Federal Regional Court of the 1st Region, suspended the decision of Judge Itagiba Catta Preta Neto, of the 4th Federal Civil Court of the Federal District Judicial Section (SJDF) in a Civil Writ of Mandamus in favor of the company Tropicalize Participações e Investimentos Ltda.
The company, responsible for operating the brands betfive.io, sportsbet.io, b2xbet.net, jetbet365.com, sorte.bet, and pinbet.io, will now have to wait until the final ruling on the appeal.
According to an investigation conducted by BNL Data, the Federal Union filed an Interlocutory Appeal against the decision that granted a preliminary injunction in favor of Tropicalize Participações e Investimentos Ltda., allowing the continuation of fixed-odds betting operations without paying the required licensing fee.
The decision mandated a judicial deposit of R$ 60 million, corresponding to two operating licenses, and ensured the company’s inclusion in the list of temporarily authorized operators.
In the appeal filed by the Federal Union, the argument was that the preliminary decision violated the regulatory framework for betting in Brazil, established by Law No. 14,790/2023. According to the Attorney General’s Office (AGU), the company had been regularly notified through the Betting Management System (SIGAP), with no irregularities in the procedure adopted by the Public Administration. Additionally, according to the Federal Union, Tropicalize had already received and responded to previous notifications through the same system, demonstrating its awareness of the electronic process.
The Federal Union also argued that the legislation established clear and non-extendable deadlines for the payment of the licensing fee and stated that a company failing to make the payment within the deadline was improperly seeking an extension that had no legal basis. The Union’s request called for the revocation of the preliminary decision, arguing that it “poses an irreparable risk to the regulation of the sector, compromising the oversight and control of betting activities in the country.” It also stated that maintaining the measure undermines the fairness of the sector, unduly favoring one company over others that complied with legal requirements.
With the suspension in place, Tropicalize Participações e Investimentos Ltda. and its brands were removed from the list of companies authorized by the Ministry of Finance’s Prizes and Betting Secretariat (SPA/MF) to operate in the national sports betting and online gaming market.
