Brazil.- August 1, 2024 www.zonadeazar.com The Secretariat of Prizes and Bets of the Ministry of Finance (SPA/MF) published, this Tuesday (30/7), Ordinance No. 1,207, of July 29, 2024, with the rules for online games and live game studios, which are part of the fixed-odd lottery betting modality. The Ordinance defines the criteria for each online game to be submitted for certification.
The regulations published today seek to comply with the provisions of Law No. 14,790/2023, which provides for the lottery modality of fixed-odd betting, and seeks to protect bettors through rules that guarantee honesty and transparency in games. It is based on international guidelines related to operational safety and reliability, used in the main markets for these games.
The Ordinance will allow certifying entities with operational capacity recognized by the SPA to determine whether or not each game can be offered on the Brazilian market. Both online games and live game studios will need to receive this certification to be offered in Brazil.
The document establishes that the online game must be random in nature, with the result determined by a random generator of numbers, symbols, figures or objects, in addition to providing the bettor with payment tables covering all winning possibilities before placing bets. . The game also needs to be of fixed odds, with the presentation, at the time of betting, of the multiplication factor that defines the amount to be received by the bettor in the event of a prize.
What is not online gambling
The rule also establishes the types of games that will not be considered fixed-odd online games and, therefore, cannot be offered by betting sites and applications authorized by the Ministry of Finance. Among them are games of skill, “fantasy sports”, multi-bettor games (games in which the bettor’s actions or results obtained by him are influenced by the result or action of another bettor) and games between bettors”. peer-to-peer” (or P2P, in which the betting operator is not involved in offering the game, providing only the environment for use by bettors). It is also prohibited to offer online games in physical establishments.

A series of ordinances that are being published by the Ministry of Finance, together with Laws 13,756/2023 and 14,790/2024, present the main specific rules for the functioning of the regulated market for the fixed-odds lottery betting modality, scheduled to operate from January 1, 2025.
