Zona de Azar Brazil – Brazil: 62 Companies Have Already Registered with SIGAP

Brazil, August 21, 2024 – The regulation of sports betting in Brazil reaches another decisive moment in its process. This Tuesday, the 20th, marks the last day for companies to apply for their registration to legally operate in the sports betting market in Brazil in 2025.

The deadline was set by the Secretary of the Secretariat of Prizes and Betting of the Ministry of Finance, Régis Dudena, in a lecture aimed at industry entrepreneurs. Therefore, companies have until the end of this Tuesday, the 20th, to apply for their registration, as failure to do so will mean no guarantee of being able to operate regularly in Brazil from January 1, 2025.

The regulation was structured in four phases

Signed on December 30, 2023, the regulation has been established in phases since the beginning of the year, totaling 4 phases, which were aimed at several important sectors for the implementation of the regulation and the adaptation of companies to the new national market scenario.

The phases were:

Phase 1 (four ordinances) – occurred until the end of April:

• Certification laboratory accreditation
• Payment methods
• Betting systems
• Authorization

Phase 2 (two ordinances) – occurred until the end of May:

• Money laundering and other crimes
• Rights and obligations

Phase 3 (three ordinances) – occurred until the end of June:

• Online gambling
• Inspection ordinance
• Sanctioning action

Phase 4 (two ordinances) – occurred until the end of July:

• Responsible Gaming
• Social allocations

Throughout this period, ordinances were issued, the last of which was the most controversial, as it authorized the “Jogo do Tigrinho” in national territory. PORTARIA SPA/MF Nº 1.207, DE 29 DE JULHO DE 2024 brought new decisions and even controversial topics by commenting on the legalization of casino games.

Through the new published ordinance, the government authorized Fortune Tiger – the famous “Jogo do Tigrinho” – with some rules. It was also specified that starting in 2025, this game, which is one of the most popular online betting games in Brazil, may be offered by Brazilian platforms.

The new law does not only address sports betting but also fixed-odds online games (where the bettor knows how much they can win based on the bet) and random result games (such as slot machines). These ordinances do not need to be voted on. They are administrative regulations issued by a ministry or other competent authority within the government and have the force of law upon publication.

The ordinance defines specific rules and procedures that must be followed within the scope of the issuing authority’s activities. Therefore, once published, an ordinance is already in effect and must be followed as specified in the document.

At the beginning of the year, 134 companies expressed interest to the Ministry of Finance

134 companies expressed interest in operating in Brazil’s sports betting market. Notable mentions include Loterias Caixa, Grupo Globo, and Kwai, which were some of the companies that showed interest in entering this market. Official expressions of interest were sent to the Ministry of Finance after the issuance of ordinance 1330/2023, which took place in October of last year, as we reported on our portal. And with these official expressions of interest, these 134 brands will have priority in authorization requests as soon as the deadline opens for receiving and paying the concession fees.

A few hours before the deadline, 62 companies have applied for registration to operate in the national market

According to data from the Secretariat of Prizes and Betting, 62 companies have applied for registration, with forty companies making the request after July 31. All these companies are already operating in the national market and would face significant losses if they were suspended at the beginning of 2025.

With just a few hours left to apply for registration, it is worth noting that companies that have not yet applied will not have any guarantee of authorization to operate at the beginning of next year, when the regulation of sports betting comes into effect across the entire national territory.
