Rio de Janeiro, January 6, 2025 www.zonadeazar.com The Rio de Janeiro State Lottery (LOTERJ) regrets the Supreme Federal Court (STF) decision on Thursday (01/02), which ordered the suspension of electronic gaming operations outside the state of Rio de Janeiro.

LOTERJ emphasizes that when establishing the rules for such activities, it used Article 3 of Complementary Law 116/2003 as a reference. This article considers services to be provided at the domicile of the service provider, applying the same legal and tax treatment as e-commerce, in strict compliance with existing legislation.

LOTERJ also states that its actions in regulating the sports betting sector within its territory were a necessary and legitimate response to the Union’s inaction. The Union allowed the deadline established by Law 13,756/2018 to pass without implementing proper federal regulations.

LOTERJ further notes that this constitutional principle was explicitly recognized and reinforced by Law 14,790/2023, which the Union claims has been violated.

For LOTERJ, the potential invalidation of the legal acts accrediting companies would result in multimillion-dollar compensations, a significant loss of tax revenue for the Union itself, and the destabilization of an entire regulated economic sector.
