Zona de Azar Brazil – Brazil: CPI on Gaming Manipulation Proposes Creating Fraud Crime in Betting Market

Brazil.- 20th March 2025 www.zonadeazar.com The Senate’s Parliamentary Commission of Inquiry (CPI) into Gaming Manipulation approved its final report on Wednesday (19 March). The document proposes including in Brazilian legislation the offences of fraud in the betting market and publicising or advertising unrealistic betting winnings.

It also suggests a constitutional amendment to make it compulsory for any citizen or authority to appear before CPIs.

It also includes two other bills focused on discouraging and restricting gambling offers. There was only one dissenting vote, from Senator Eduardo Girão (Novo-CE). The proposals will be sent to the Senate Bureau for processing.

In the report, authored by Senator Romário (PL-RJ), it is proposed to include in the General Sports Law (14.597/23), among the crimes against the uncertainty of sports results, fraud in the betting market and the disclosure or advertising of unrealistic betting winnings. It was also suggested that the penalty for the offence of cheating the outcome of a sporting event, which is already provided for in the legislation, be increased. Currently, it is two to six years in prison. The proposal is for four to ten years.

CPI on the Manipulation of Games and Sports Betting votes on final report

A second bill would add to the Bets Law (Law 14.790/23) the obligation to provide warnings to discourage gambling and warn about its harmful effects. According to the bill, it becomes the duty of gambling operators to inform gamblers ‘in a prominent manner’ about the risks of debt, addiction, pathological gambling disorders and the loss of bets. This should be done when registering and accessing the betting system.

There is also a third suggestion that the Betting Law should restrict the offer of bets on isolated events during sporting events.

The constitutional amendment suggests compulsory attendance at CPIs, with the possibility of using police force. In the report, Romário criticises the decision by Justice André Mendonça, endorsed by the Second Panel of the Federal Supreme Court (STF), which released influencer Deolane Bezerra from her obligation to testify at the CPI on Sports Betting in October last year.

‘CPIs study facts, keep society informed, and thus monitor the laws that Parliament passes and collect data to improve legislation. Therefore, it is undue interference by the judiciary to release people from attending parliament to clarify facts. Society suffers as a result. Decisions like this tend to make the CPI institute unfeasible in time,’ says Romário.

The report of the CPI on the Manipulation of the Games sent guidelines to the ministries of Finance, so that it can act as a supervisory agent, and of Sport. It also suggested to the Brazilian Football Confederation (CBF) clearer and more transparent criteria for video referee decisions and an increase in VAR technology to make the resource more reliable.

In the document, Romário calls for the indictment of Bruno Tolentino, Lucas Paquetá’s uncle, and businessmen William Pereira Rogatto and Thiago Chambó Andrade, also for match-fixing.
