Nebraska Moves Closer to 2026 Online Sports Betting Vote

Tax Relief Nebraska submitted approximately 350,000 signatures, including more than 201,000 supporting a constitutional amendment and 146,000 backing a companion statutory measure. Although the constitutional petition exceeds the estimated 127,054-signature requirement, both proposals must still complete the official verification process.

Nebraska currently permits only retail sports betting at licensed racetrack casinos. If approved, the constitutional amendment would allow authorised gaming operators and their platform providers to offer online sports betting under the Nebraska Racetrack Gaming Act to customers aged 21 and over. Each casino would be permitted to partner with up to two online sportsbooks, creating a maximum of 10 mobile sportsbooks statewide.

The accompanying statutory proposal would allocate 70% of online sports betting tax revenue to property tax relief, mirroring the existing allocation model used for casino gaming taxes. However, the measure would only take effect if voters also approve the constitutional amendment.

Industry Context

Supporters argue that Nebraska is losing tax revenue to neighbouring states such as Iowa, Kansas, Colorado, Wyoming and Missouri, all of which already permit mobile sports betting. They also contend that the state’s retail-only model limits access, particularly for residents living far from Nebraska’s five licensed casinos.

If approved by voters, Nebraska would join the growing number of US states with regulated online sports betting.
