Joe Asher Challenges Prediction Markets After Boomer’s First Year

Founder and CEO Joe Asher has also addressed the growing presence of prediction markets in the United States, arguing that these platforms effectively operate as gambling businesses and should face the same regulatory requirements as conventional sportsbooks.
Expansion Ahead of Expectations
Boomer’s had originally hoped to reach around 10 locations after its first year.
Instead, the company will have 16 locations operating by 1 September, in time for the start of the football season.
It expects to reach 20 locations by November.
The expansion has therefore progressed considerably faster than initially projected.
Targeting 30 Locations
Asher expects the network to continue growing during its second year.
Boomer’s plans to finish 2026 with 20 locations and reach approximately 30 by the end of 2027, potentially exceeding that figure.
The company intends to remain focused exclusively on Nevada.
Technology Supports Low-Cost Expansion
Technology has been one of the factors enabling faster growth.
At smaller casinos, Boomer’s can operate with only one or two betting kiosks without requiring permanent daily staffing.
Once installation and licensing expenses have been completed, this structure creates a relatively low ongoing cost base.
Incentives for Casino Partners
Boomer’s has also structured commercial agreements to align its interests with casino partners.
When a customer registers for a mobile account at a particular casino, that customer continues to be attributed to the property when subsequently wagering through the mobile app.
This gives casinos a direct incentive to support mobile customer acquisition.
Independent Sportsbook Positioning
The company is positioning itself as an independent, Nevada-specific sportsbook.
Asher said some casino operators that previously worked with William Hill have shown interest in partnering with an independent company again following William Hill’s acquisition by Caesars.
Boomer’s also believes its smaller scale enables it to place greater value on each casino relationship.
Focus on Local Bettors
The business is primarily focused on Nevada residents rather than tourists.
Boomer’s views local customers as capable of betting throughout the year, while visitors only generate activity during their stay.
Its promotions therefore focus on teams and competitions particularly relevant to Nevada residents, including the Vegas Golden Knights, Las Vegas Raiders and Nevada Wolfpack.
Competing on Price
For the upcoming NFL season, Boomer’s will bring back its -105 pricing, which proved popular with customers during the previous year.
The sportsbook will also retain higher parlay payouts.
Asher believes that as a late entrant into a mature mobile betting market, Boomer’s needs to provide a clear economic reason for customers to open an additional betting account.
Prediction Markets Create Competitive Impact
Asher acknowledged that prediction markets are having some impact on Nevada’s traditional betting industry, although he said Boomer’s does not yet have sufficient historical data to quantify it.
He noted that prediction-market platforms had been active in Nevada before agreements with the Gaming Control Board required transactions in the state to be blocked.
Asher Says They Are Gambling Businesses
Asher’s position is that sports prediction markets should be treated in the same way as sportsbooks.
He argues that they should face:
- The same licensing requirements.
- The same probity checks.
- The same gambling regulations.
- The same state oversight.
- Applicable gambling taxes.
He considers it unfair for regulated Nevada operators to compete against businesses operating under a different regulatory structure.
Questions CFTC Authority
Asher also questioned the role of the Commodity Futures Trading Commission in overseeing contracts that he believes amount to sports betting.
He argues that gambling regulation is primarily a state responsibility.
The Boomer’s founder expects the legal dispute to ultimately be resolved through the courts and potentially by the US Supreme Court.
States That Prohibit Gambling
Asher cited Utah as an example in his criticism of federally regulated prediction markets.
The state has historically chosen to prohibit gambling.
He argues that allowing prediction-market platforms to offer sports contracts in jurisdictions that have expressly rejected gambling conflicts with states’ regulatory rights.
Tax Debate
Taxation is another major part of Asher’s argument.
He pointed to New York, where licensed sportsbooks face a 51% tax rate on gaming revenue, while prediction markets do not currently pay the equivalent state gambling tax.
Asher believes this creates an uneven regulatory and fiscal playing field.
Prediction Markets as Betting Exchanges
The Boomer’s founder also rejected the idea that sports prediction markets represent entirely new technology.
In his view, they are essentially betting exchanges, a model that has existed for roughly 25 years.
The key difference is the regulatory framework under which they are currently being offered in the United States.
Nevada to Remain the Sole Market
Boomer’s does not currently plan to expand beyond Nevada.
The company sees the state’s in-person registration requirement for mobile betting accounts as a fundamental part of its business model.
Asher said this feature enables the physical casino network to serve as the acquisition base for the sportsbook’s digital operations.
Industry Context
Prediction markets have become one of the most important regulatory disputes within the US betting sector.
While platforms such as Kalshi rely on a federal framework for event contracts, several state gambling regulators argue that certain sports products amount to wagering governed by state laws.
