Brazil: Government Admits It Does Not Oversee eSports Betting

Brazil – April 16, 2025 – www.zonadeazar.com The Federal Government has acknowledged that it currently does not oversee betting platforms that use in-game skins from titles like Counter-Strike 2. According to the Ministries of Sports and Finance, these platforms are not subject to the current Betting Law and therefore operate without specific regulation in the country.
The National Secretariat for Sports Betting told Dust2 that it is not within its scope to recognize the use of skins as an indirect currency in online betting and referred the matter to the Secretariat of Prizes and Betting (SPA) of the Ministry of Finance.
However, the SPA also stated it has no authority to act in these cases. Despite the lack of regulation, the Sports Secretariat said it monitors the issue and emphasized that skins are the responsibility of game developers.
It is important to note that the current situation regarding skins is tied to the reality of each game and is the responsibility of its developer. Regulatory provisions—whether or not skins are banned—could lead to legal issues involving consumer rights, intellectual property rights, and civil liability, according to the National Secretariat for Sports Betting.
Therefore, according to the agency, any regulation would involve legal matters such as intellectual property and consumer rights. The government has also not taken a position on the use of loot boxes, despite a lawsuit filed by ANCED requesting their prohibition.
The initiative is supported by the AGU, the Public Prosecutor’s Office of the Federal District (MP-DF), and the National Consumer Secretariat. While Brazil still lacks specific regulations on the matter, countries such as Australia and Denmark have already banned such sites. Valve, the developer of CS2, has also been fighting these practices through bans and changes to Steam’s rules.
