Mayor Emília Corrêa vetoes Lotaju proposal over constitutional concerns

Brazil.- July 23, 2025 www.zonadeazar.com The Mayor of Aracaju, Emília Corrêa, has vetoed the bill establishing the Municipal Lottery of Aracaju (Lotaju) after review by the City Attorney’s Office (PGM).

The veto, now sent to the City Council, is based on three legal points: lack of municipal legislative authority, violation of constitutional principles, and procedural flaws.

📌 The Brazilian Constitution reserves lottery operations to the federal and state governments, excluding municipalities.
📌 The proposal would violate the federal pact and free competition by allowing the city to collect lottery revenues along with federal and state transfers.
📌 There is no clear local interest to justify municipal lottery operations, which involve economic and consumer protection impacts requiring federal regulation.
📌 Establishing public services and defining budgets are exclusive responsibilities of the local executive branch.

With this, Aracaju remains outside the trend of municipal lotteries expanding in other Brazilian cities.
