Brazil will hold a presidential runoff on 25 October, while the gaming industry continues efforts to overturn the ban introduced under Provisional Measure 1.394/2026.
Flávio Bolsonaro Leads First Round
Liberal Party candidate Flávio Bolsonaro received 47.03% of the vote in the first round.
President Luiz Inácio Lula da Silva secured 45.16%.
As neither candidate exceeded 50%, the presidency will be decided in a second-round vote.
Ban Remains in Force
Lula signed Provisional Measure 1.394/2026 on 25 September.
The measure prohibited across Brazil:
- Fixed-odds betting operations.
- The offering of betting products.
- Intermediation.
- Advertising.
- Sports betting.

From 6 October, authorised betting websites and applications are required to remain unavailable to Brazilian users.

The Liberal Party won 121 of the Chamber of Deputies’ 513 seats, making it the largest single bloc.

Congress May Take a Different View
Atucha argues that lawmakers may assess the issue from a longer-term perspective than presidential candidates campaigning ahead of the runoff.

Opposition Does Not Guarantee Market Return
Bichara e Motta Advogados partner Udo Seckelmann cautioned that stronger opposition representation would not automatically result in Congress rejecting the ban.
The debate increasingly involves consumer protection, illegal gambling, legal certainty and the effectiveness of prohibition compared with regulation.
Bolsonaro Has Also Questioned Online Casino
A Flávio Bolsonaro victory would not necessarily restore the previous framework in full.
While he criticised Lula’s decision to ban the entire sector, Bolsonaro has also previously argued against online casino while indicating greater willingness to preserve sports betting.
The election result alone therefore does not determine what future regulatory model could emerge.
Supreme Court Could Also Be Decisive
Congress is not the only institution capable of changing the outlook.
Brazil’s Supreme Federal Court is considering litigation related to the betting framework and the new provisional measure.
The country’s leading industry associations have already challenged the ban before the STF.
Judicial decisions could therefore alter the regulatory environment regardless of the presidential result.
Investor Confidence
The uncertainty is also affecting international perceptions of Brazil’s market.
Operators paid approximately BRL30 million per authorisation, established local operations and invested significant capital to enter the regulated framework.
