Court Overturns Stake Temporary Relief and Restores Brazil Betting Ban
Brazil.- 13 October 2026 | www.zonadeazar.com Stake has lost the temporary court protection that allowed it to continue operating in Brazil until 25 October.
A Federal Regional Court suspended the injunction previously granted by the 9th Federal Civil Court of São Paulo, returning the company to the same prohibition regime affecting the rest of Brazil’s fixed-odds betting market.
Permission Had Been Granted Last Week
The original ruling had allowed Stake to remain operational on a provisional basis until 25 October.
That decision effectively made the company the only licensed operator able to continue offering bets after the wider market shutdown.
Regional Court Suspends Injunction
The decision was overturned by the Federal Regional Court.
Judge Di Salvo suspended the preliminary relief and focused particularly on the consequences of allowing one company to continue operating while every other licensed operator remained subject to the ban.
Regulatory Asymmetry Cited
The court said the situation created a regulatory asymmetry.
According to the ruling, allowing only Stake to remain active could interfere with implementation of the federal public policy introduced by the Government.
Stake Again Subject to the Ban
With the injunction suspended, Stake no longer benefits from a judicial exception allowing it to offer betting services.
The company is therefore once again fully subject to Provisional Measure 1.394/2026, which prohibits the operation, offering, intermediation and advertising of fixed-odds betting across Brazil.
Initial Decision Had Opened a Legal Gap
The original injunction had generated significant interest across the regulated industry.
Stake became the first operator to secure a court ruling partially challenging the timing and impact of the ban.
The first-instance judge had interpreted the Provisional Measure as recognising a separate 30-day period before certain licences were fully suspended.
Operations Were Subject to Conditions
Even while protected by the temporary order, Stake was subject to strict conditions.
These included:
- No new customer registrations.
- No new promotions.
- No sign-up bonuses.
- Continued AML controls.
- Continued age verification.
- Continued self-exclusion systems.
- Unrestricted withdrawals and refunds.
- Full regulatory reporting.
Government Maintains Its Position
Federal authorities continue to defend the prohibition.
The official justification centres on public-interest concerns including household debt, public health and consumer protection.
Licensed Sector Continues to Challenge the Measure
The regulated betting industry remains opposed to the ban.
Operators and trade bodies including ANJL and IBJR argue that the measure undermines multi-year licences granted by the State and damages legal certainty for companies that paid substantial authorisation fees and invested in compliance.
Market-Wide Shutdown Remains in Force
Licensed platforms had already stopped taking bets from 6 October.
The Government has also established a timetable for returning customer balances, which remains in force during October.
Legal Debate Remains Open
The reversal of Stake’s injunction does not settle the wider legal dispute.
The constitutionality and long-term validity of the prohibition remain subject to further judicial and Congressional scrutiny.
Next Steps or Impact
The suspension removes, for now, the most significant exception within Brazil’s former regulated betting market.
It also makes it harder for other operators to rely immediately on the Stake case as a precedent to remain active.
However, the broader legal battle remains unresolved and will ultimately depend on future court decisions and Congressional consideration of Provisional Measure 1.394/2026.
