Louisiana Delays DraftKings Licence Renewal Amid AI Investigation
United States.- 20 October 2026 | www.zonadeazar.com The Louisiana Gaming Control Board (LGCB) has postponed the full renewal of DraftKings’ sports betting licence while investigating the company’s use of artificial intelligence in its commercial practices and certain aspects of player protection.
On 15 October 2026, the regulator unanimously approved a conditional four-month extension, allowing DraftKings to continue operating in the state.
The temporary authorisation will remain valid until 19 February 2027, with a hearing on the full licence renewal scheduled for 18 February.
Investigation Into Artificial Intelligence
The decision follows allegations concerning the potential use of artificial intelligence to identify specific customer profiles and deliver targeted gambling promotions.
According to reports reviewed by the regulator, these strategies could involve analysing customer behaviour to encourage additional betting activity.
The investigation will examine whether DraftKings’ commercial practices comply with responsible gambling and consumer protection requirements.
Areas under consideration include:
- The use of algorithms to analyse betting behaviour.
- Customer segmentation practices.
- Promotional offers and bonus incentives.
- Safeguards for potentially vulnerable players.
The regulator has not established that DraftKings has committed any wrongdoing.
Shareholder Reviews and Regulatory Requirements
The investigation also covers matters relating to DraftKings’ shareholder structure.
Louisiana State Police’s Gaming Enforcement Division identified that certain shareholders holding 5% or more of the company had not completed the required suitability assessment procedures.
DraftKings must provide additional documentation to address these issues.
The conditional extension includes seven requirements, covering disclosures about artificial intelligence, prediction market activities and compliance with advertising regulations.
The operator must respond to several requests within 30 days.
DraftKings Denies Allegations
Paul Liberman, DraftKings’ co-founder and President of Operations, appeared before the regulator to address the concerns.
Liberman acknowledged that the company maintains records enabling it to identify whether customers are winning or losing money. However, he denied that DraftKings uses artificial intelligence to harm consumers or specifically target losing bettors with promotions.
Meanwhile, LGCB Chairman Chris Hebert emphasised that the conditional extension does not constitute a finding of misconduct.
He explained that the measure allows the board to fulfil its supervisory responsibilities while completing the necessary investigations.
Next Steps and Impact
DraftKings’ existing licence expires on 10 November 2026, but the approved extension ensures that its operations in Louisiana can continue without interruption.
A new hearing is scheduled for 18 February 2027, immediately before the temporary authorisation expires.
The case highlights growing regulatory scrutiny of artificial intelligence, customer segmentation and personalised marketing within the US sports betting industry.
For the wider iGaming sector, the proceedings could help shape expectations around transparency and regulatory oversight of operators’ technological tools.
