New Jersey Mandates Player Monitoring and Intervention for Online Gambling

United States.- 23 October 2026 | www.zonadeazar.com New Jersey has become the first US state to introduce mandatory behavioural monitoring requirements for online casino and sports betting operators.

Announced by Attorney General Jennifer Davenport and the Division of Gaming Enforcement (DGE), the regulations establish a system for identifying potentially harmful gambling behaviour and implementing a three-stage intervention process.

The new requirements are legally enforceable, with operators potentially facing regulatory sanctions for non-compliance.

New Indicators for Identifying At-Risk Players

Operators must monitor customer activity and conduct assessments when certain behavioural patterns are detected.

Key triggers include:

  • Deposits exceeding US$10,000 within 24 hours.
  • Deposits exceeding US$100,000 over 90 days.
  • Betting turnover of at least US$1 million within 90 days.
  • Three visits to the state’s self-exclusion website within 30 days without registering.
  • Three cancelled withdrawal requests within ten days.
  • A second cooling-off request within 45 days.
  • A 50% increase in login time compared with the previous two weeks.

Operators must also consider patterns involving increased wagering amounts or repeated sessions ending with balances below one dollar.

Meeting one of these thresholds does not automatically establish problem gambling, but it requires the operator to review the customer’s activity.

A Three-Stage Intervention Framework

When operators identify potential signs of gambling-related harm, they must place affected customers on an at-risk monitoring list and apply interventions according to the assessed risk.

Stage One: Information and Prevention

The customer receives an email explaining responsible gambling tools, including deposit, loss and time limits, cooling-off periods and self-exclusion options.

Stage Two: Mandatory Education

The player must watch an educational video before being allowed to resume gambling.

Stage Three: Personal Contact

The operator must contact the customer directly by telephone or video call and provide information about responsible gambling professionals.

If the customer is confirmed to remain at risk following this intervention, the account may be closed. Suspension may also follow unsuccessful attempts to establish contact.

New Responsibilities for Licensed Operators

The regulations require every licensed online gambling operator to appoint a dedicated responsible gaming lead.

This individual will oversee behavioural monitoring, risk assessments and the implementation of intervention measures.

The DGE will also be able to assess whether operators properly document their reviews and comply with intervention requirements.

Although gambling companies already maintained player protection programmes, there was previously no uniform, legally enforceable standard specifying when additional reviews and interventions were required.

Comments from State Authorities

Jennifer Davenport, New Jersey Attorney General, emphasised that the new regulations are designed to ensure operators identify potentially harmful behaviour and provide appropriate support.

She also raised concerns about reports alleging aggressive marketing practices targeting customers displaying possible signs of gambling-related disorders.

Meanwhile, Mary Jo Flaherty, Interim Director of the DGE, explained that the measures would support earlier interventions tailored to individual circumstances.

Governor Mikie Sherrill welcomed the initiative and highlighted the importance of using behavioural data to strengthen online gambling safeguards.

Additional Support and Prevention Tools

Alongside the regulatory changes, New Jersey announced a partnership with RecoverMe, an application designed to support individuals experiencing gambling-related difficulties.

The service provides tools based on cognitive behavioural therapy and mindfulness techniques, alongside features for monitoring gambling habits.

RecoverMe will be available free of charge to individuals located in New Jersey.

The programme complements GamFin, an existing financial counselling service supporting players and families affected by gambling-related financial harm.

Industry Impact and Next Steps

The new regulations represent a significant development in the oversight of online gambling in the United States.

Operators will need to strengthen their data analysis systems, establish clear intervention procedures and demonstrate compliance with monitoring requirements.

For the wider industry, New Jersey’s approach could become a reference point for future regulatory initiatives in other states.

The measures represent a shift from voluntary responsible gambling recommendations towards mandatory, preventative monitoring and intervention.
