New York Takes Kalshi to Court Over Prediction Market Records
United States.- 27 October 2026 | www.zonadeazar.com The New York State Gaming Commission (NYSGC) has asked a court to compel Kalshi, the US prediction market operator, to provide documents relating to its sports-event contracts.
The petition, filed on 22 October 2026 before a Manhattan state court, forms part of an investigation into whether certain Kalshi products constitute sports betting conducted without the required state licence.
The development represents another stage in the ongoing dispute between state gambling authorities and federally regulated event-contract platforms.
New York Requests Four Categories of Information
The Commission filed its petition in the Supreme Court of the State of New York, New York County, naming Kalshi Inc. and KalshiEX LLC as respondents.
The regulator is seeking enforcement of investigative subpoenas issued on 31 July 2026, with an original compliance deadline of 14 August.
The requested information covers four areas:
- Sports-event contracts: information about the markets offered and their characteristics.
- Customers under 21: products and services available to New York residents aged 18 to 20.
- Advertising: promotional materials describing Kalshi’s contracts as wagers or bets.
- Corporate structure: information concerning the company’s ownership and organisation.
The Commission argues that these records are necessary to assess potential violations of state gambling legislation.
Regulator Challenges Kalshi’s Responses
According to the court filing, Kalshi allegedly provided incomplete responses to certain requests and declined to produce other documents.
State authorities maintain that the information is necessary to determine the extent of the company’s operations in New York.
The investigation is being conducted under New York’s legislation governing racing, pari-mutuel wagering and sports betting.
The Commission also wants to establish whether civil penalties should be imposed and, if so, their potential amount.
These allegations remain part of pending proceedings and do not constitute a final judicial finding of unlawful conduct.
Minimum Age Requirements Become a Central Issue
One of the regulator’s main concerns involves access to sports-related contracts by customers under the age of 21.
In New York, licensed online sportsbooks must restrict their services to individuals aged 21 or older.
However, federally regulated prediction markets may operate under different eligibility requirements.
The Commission therefore wants to determine which products Kalshi makes available to residents aged 18 to 20 and under what conditions.
The findings could be relevant to determining whether the company’s operations should fall under state sports betting rules.
Kalshi Defends Federal Oversight
Kalshi maintains that its products are not traditional sports wagers, but financial derivatives regulated by the Commodity Futures Trading Commission (CFTC).
The company argues that federal commodities legislation takes precedence over state gambling restrictions affecting its event contracts.
Kalshi has also challenged the subpoenas, arguing that they may represent an improper attempt to obtain evidence connected to separate, ongoing litigation.
The dispute raises a fundamental legal question: whether states can enforce gambling laws against sports-event contracts supervised by federal financial regulators.
Background to the Legal Dispute
The conflict between Kalshi and New York intensified in October 2025, when the Gaming Commission ordered the company to cease what it described as unlicensed mobile sports wagering.
Kalshi subsequently filed federal proceedings seeking to protect its operations.
In July 2026, US District Judge Analisa Torres denied the company’s request for a preliminary injunction.
Later, on 31 July, Attorney General Letitia James and Governor Kathy Hochul initiated a separate civil enforcement action against Kalshi.
The lawsuit seeks to halt activities the state considers unlawful, recover certain proceeds and impose potential financial penalties.
Next Steps and Industry Impact
The latest petition concerns whether Kalshi must provide the records requested by the Commission.
The court has not yet ruled on whether the company must comply with the subpoenas, nor has it issued a final determination on the legality of Kalshi’s sports contracts.
The case could have implications for other prediction market platforms offering similar products in the United States.
For the iGaming industry, the controversy highlights growing tensions between federal financial regulation, state gambling powers, consumer protection and sports betting licensing requirements.
The outcome could help clarify the investigative authority of state regulators over prediction market operators.
