The 6th Chamber of the Regional Federal Court of the 1st Region dismissed the appeal filed by the Attorney General’s Office (AGU) against the injunction obtained by Loterj from the Federal Court of the Federal District on Wednesday (11).

The decision maintains the suspension of the Ministry of Finance’s ordinances that mandated mandatory accreditation of betting companies with the Union. As a result, companies authorized in Rio de Janeiro can continue operating.

The 6th Chamber of the Regional Federal Court of the 1st Region (TRF1) rejected an appeal from the Attorney General’s Office (AGU) and upheld the suspension of the Ministry of Finance’s ordinances that required mandatory accreditation of sports betting companies with the Union.

This decision benefits the State Lottery of Rio de Janeiro (Loterj), which has regulated the sector’s operations since April 2023.

As a result of the ruling, companies operating under Loterj’s accreditation can continue their activities in accordance with the rules established by the state authority, without needing federal approval.

The suspension of the ordinances reinforces Loterj’s autonomy in regulating the sector within the state of Rio de Janeiro.

The Ministry of Finance issued the ordinances as part of a national regulatory policy for the sports betting sector, including accreditation and supervision requirements by the federal government. However, Loterj contested the measure, arguing that it has the authority to regulate lottery activities within the state.
