Brazil – November 27, 2024 www.zonadeazar.com To enhance bettor protection, the Secretariat of Prizes and Betting of the Ministry of Finance published, on Tuesday (11/26), a new ordinance regulating the migration of funds and data from bettors. This marks another step toward the launch of the regulated market on January 1, 2025.
Ordinance SPA/MF No. 1,857, dated November 25, 2024, aims to govern the transfer of funds and data from bettors currently using betting websites during the transition period, which ends this year, to sites authorized by the Ministry of Finance starting January 1. Currently, many betting sites are operated by companies based abroad. Next year, only websites with the “.bet.br” extension — exclusively for authorized companies based in Brazil — will be legally allowed to operate in the country.
The measure regulates the transfer of funds and data from bettors using sites during the current transition period to those authorized by the Ministry of Finance as of January 1.
This transfer will require the bettor’s authorization, which involves registering on the new website following rules established by the Ministry of Finance. These rules include facial biometric registration and linking a bank account from which funds for betting will be withdrawn and winnings deposited.
If a bettor does not consent to the transfer of their funds, or if the site operator fails to secure authorization, the funds must be refunded by December 31. For pending bets, bettors can either cancel and receive a full refund or maintain their bets, which will then be managed by the authorized company.
In all cases, bettors’ data will be protected according to the General Data Protection Law (LGPD) and Ordinance No. 722/2024.
Companies managing the migration must submit a list of participating bettors by December 13.
