Brazil: Finance Ministry Tightens Rules on Commercial Prizes

Brazil.- July 02, 2026 www.zonadeazar.com The Ministry of Finance has published a new order that strengthens the requirements for running commercial promotions involving the free distribution of prizes, expanding the oversight mechanisms and imposing stricter penalties on companies that fail to comply with the regulations.

The measure stipulates that promotions carried out without the necessary authorisation may result in fines of up to 100 per cent of the total value of the prizes distributed, in addition to the possibility of suspension of related activities for up to three years, depending on the severity of the offence. The initiative aims to strengthen the legal certainty of commercial promotions and enhance consumer protection.

Stricter enforcement

The new regulations also set out procedures for investigation, enforcement and the imposition of administrative sanctions, providing greater predictability to the processes conducted by the Secretariat for Prizes and Betting (SPA).

Among the new provisions, the ministerial order regulates the use of the Letter of Undertaking, an instrument that allows for the resolution of certain infringements through the fulfilment of specific obligations, provided that this is in the public interest and complies with current legislation.

Strengthening the regulatory environment

According to the Ministry of Finance, the changes form part of a strategy to modernise the supervision of commercial promotions and strengthen the SPA’s regulatory role, with a view to ensuring greater transparency, legal certainty and compliance for companies that use promotional campaigns as a marketing tool.
