The case had initially been included on the April agenda but was later removed from the schedule by Edson Fachin, STF justice and current president of the court.

The proceedings originate from STF Theme 924, which examines the validity of Article 50 of the 1941 Criminal Misdemeanours Law, the provision that classifies gambling operations as a criminal offence in Brazil.

During the trial, the justices will decide whether that provision was incorporated by the 1988 Federal Constitution. The ruling will have general repercussion, meaning it must be applied to all similar cases currently pending in the country.
