Niterói Bans Betting Advertising in Public Spaces

Brazil.- 11 September 2026 | www.zonadeazar.com The city of Niterói, in the state of Rio de Janeiro, has banned advertising for sports betting and fixed-odds gambling platforms across public spaces and outdoor advertising throughout the municipality.

Mayor Rodrigo Neves formalised the measure through Decree No. 960/2026, published on 9 September.

The new rules broadly restrict betting-brand exposure on public assets, outdoor advertising structures, municipal events and other activities subject to local concessions, permissions, authorisations or licences.

Ten Days to Remove Existing Advertising

Advertising already installed in breach of the new rules must be removed or adapted.

The decree establishes a 10-day period from publication for compliance.

Fines specifically linked to the new ban will be suspended during that transition period.

Direct and Indirect Advertising Covered

The measure does not apply solely to conventional advertisements.

Indirect promotion capable of identifying a betting operator or platform is also prohibited.

This prevents businesses from maintaining brand visibility through alternative promotional devices that do not explicitly invite consumers to wager.

Brands and Company Names

The ban covers the corporate names and brands of betting operators.

Displaying a gambling company’s identity in regulated public spaces can therefore fall within the restriction.

Websites and Applications

The measure also applies to references to:

  • Websites.
  • Mobile applications.
  • Digital betting platforms.

This is intended to prevent outdoor advertising from functioning as a gateway into online betting services.

Promotions and Bonuses

Promotional messages are included.

The restriction covers references to:

  • Bonuses.
  • Prizes.
  • Promotional incentives.
  • Acquisition campaigns.

The policy therefore reaches some of the most common marketing tools used to attract new betting customers.

Logos, Symbols and Mascots

The decree additionally covers:

  • Logos.
  • Symbols.
  • Mascots.
  • Slogans.

A betting business cannot necessarily avoid the rules simply by removing its full corporate name while retaining recognisable branding.

Sponsorship Also Restricted

The policy extends beyond advertising displays.

It includes sponsorship arrangements connected with activities contracted, sponsored or organised by the municipal administration.

This significantly broadens its potential effect on institutional marketing.

Municipal Events

Events involving Niterói City Hall will have to comply with the restrictions.

Betting-brand visibility can therefore be prohibited even when appearing as part of an event rather than through a conventional advertising concession.

Advertising Visible From Outside an Event

The decree also introduces a visibility test.

Betting advertising can fall within the restriction when placed inside an event but still visible from the exterior.

This is designed to prevent advertisers from bypassing the rule through installations technically located inside controlled areas.

Public Contracts Must Adapt

Municipal departments and agencies must apply the new requirements when managing:

  • Contracts.
  • Concessions.
  • Permissions.
  • Authorisations.
  • Licences.

This is particularly relevant to agreements involving commercial exploitation of public advertising space.

Impact on Outdoor Advertising Companies

Companies managing billboards, urban furniture and other advertising structures will also need to adjust.

They must ensure campaigns running on their inventory comply with the new restrictions.

Responsibility therefore extends beyond betting operators themselves.

Protecting Children and Teenagers

Reducing exposure among children and teenagers is one of the municipality’s principal stated objectives.

Authorities are concerned that repeated visibility of betting brands may normalise gambling among younger audiences.

Protection of minors is consequently central to the rationale behind the decree.

Mental Health and Social Wellbeing

The city has also linked the restrictions with potential harms caused by compulsive gambling.

Concerns include:

  • Addiction.
  • Debt.
  • Mental-health problems.
  • Family impact.
  • Wider social harm.

The measure therefore incorporates a public-health rationale alongside advertising regulation.

Mayor Rodrigo Neves Defends the Policy

Mayor Rodrigo Neves said the continued expansion of online betting requires responsible public-sector action.

The municipality argues that daily betting advertising should not be normalised when it also reaches children and young people.

Municipal Action Within a National Market

Licensing and regulation of betting operators remain federal responsibilities.

Niterói is instead using local powers covering public spaces, outdoor advertising, permits and urban regulation.

This allows the municipality to limit physical brand exposure without changing the federal betting-licensing system.

Betting Operations Are Not Banned

The decree does not prohibit betting companies from operating in Niterói.

Federally authorised operators may continue providing their services under national law.

The restrictions concern advertising in public spaces and outdoor media.

Federal Authority Remains

Authorisation and regulation of betting platforms continue to sit with Brazil‘s federal government.

Niterói is therefore not attempting to replace the national gambling regulator.

Its action is confined to areas falling within municipal jurisdiction.

Seop to Lead Enforcement

The city’s Public Order Secretariat, Seop, will help enforce the decree.

Its role links the policy directly to municipal rules governing use of urban space and public order.

Urban Planning and Mobility Secretariat Involved

The Municipal Secretariat for Urban Planning and Mobility will work alongside Seop.

Its responsibilities include areas relevant to advertising structures and urban authorisations.

Fines for Non-Compliance

Once the transition period ends, breaches can trigger sanctions under Niterói’s municipal code.

Fines are among the penalties available.

Advertising Can Be Removed

Authorities may also order physical removal of non-compliant advertising pieces.

This gives the municipality a direct enforcement tool once the grace period expires.

Authorisations Can Be Cancelled

Additional administrative penalties are available.

Permits or authorisations connected with advertising displays may be revoked or annulled.

Advertisers and Display Operators Face Liability

Both advertisers and those responsible for displaying the material may face consequences.

The approach prevents responsibility being shifted entirely from one party to another.

Federal Public Prosecutor Recommendation

The decree follows a recommendation from Brazil‘s Federal Public Prosecutor’s Office.

At the end of August, the authority had recommended that Niterói introduce restrictions on betting advertising in public spaces.

Rio de Janeiro Used as a Reference

A comparable decree introduced by the city of Rio de Janeiro was cited as a reference.

Niterói therefore joins a developing municipal trend.

Belo Horizonte Has Also Acted

Belo Horizonte is among the Brazilian municipalities that have introduced similar restrictions.

The development demonstrates that betting advertising is increasingly being addressed not only federally but at local-government level.

Cuiabá and Ribeirão Preto

Other cities following the same broader direction include:

  • Cuiabá.
  • Ribeirão Preto.

Each municipality is using its own powers over public advertising and urban assets to limit betting exposure.

Growing Municipal Trend

Niterói’s decision may therefore represent part of a larger regulatory shift.

While the federal government determines who can legally operate, municipalities are beginning to decide where and how betting brands can appear in the urban environment.

Impact on Marketing Strategies

A broader spread of municipal restrictions could materially affect offline customer-acquisition strategies.

Outdoor media, public-space advertising, promotional activations and municipal sponsorships could become unavailable in an increasing number of cities.

Operators may need to monitor local rules alongside national requirements.

Greater Weight on Digital Marketing

Restrictions on physical advertising could make digital acquisition channels even more important.

However, online betting advertising is also subject to growing regulation in Brazil.

The combined effect may gradually reduce the range of mass-market promotional options available to operators.

Sponsorship Under Greater Scrutiny

Including municipal events is particularly significant.

Sponsorship remains an important visibility tool for betting companies.

Restrictions on such arrangements force operators to reassess which properties and events can continue carrying their brands.

Advertising and Operating Rights Are Separate

The decree establishes a clear distinction.

A company may be fully authorised to offer betting in Brazil while still being prohibited from advertising through certain channels in Niterói.

Operating approval and advertising freedom are therefore separate regulatory questions.

Multi-Level Regulation

Brazil‘s betting environment is becoming increasingly complex.

The federal government controls licensing and betting operations.

States and municipalities can nevertheless intervene within their own responsibilities in areas including advertising, public spaces, consumer protection and public health.

Responsible Gambling as a Municipal Issue

Gambling-related harm is also becoming a justification for local policymaking.

Niterói presents reduced advertising exposure as a preventive measure.

The municipality wants to act before problematic behaviours become entrenched.

Advertising and Gambling Normalisation

A central concern is the frequency with which consumers encounter betting messages.

Authorities argue that constant presence in everyday public environments can make gambling appear normal or routine.

Children and adolescents are considered particularly vulnerable to that effect.

Industry Context

Brazil continues to refine the regulatory environment surrounding its licensed fixed-odds betting market.

At federal level, policymakers are debating advertising, player protection and responsible gambling.

At the same time, Rio de Janeiro, Belo Horizonte, Cuiabá, Ribeirão Preto and now Niterói are using municipal powers to reduce physical betting advertising.

Next Steps and Impact

Advertising currently installed in Niterói has 10 days from publication of Decree No. 960/2026 to be removed or adapted.

After that period, Seop and the Municipal Secretariat for Urban Planning and Mobility can impose penalties including fines, removal of advertising and cancellation of relevant authorisations.

The decree does not affect the right of federally licensed operators to offer betting, but it significantly restricts their use of public spaces and outdoor media to promote their brands.

If additional municipalities adopt comparable rules, betting companies may face an increasingly fragmented advertising landscape in which national campaigns must also comply with city-specific restrictions.
