Brazil: Public Consultation on SPA’s Regulatory Agenda Ends Thursday (3/27)

March 26, 2025www.zonadeazar.com The public consultation for the development of the Regulatory Agenda of the Secretariat of Prizes and Betting (SPA/MF) for the 2025-2026 biennium will close next Thursday, March 27. The agenda is expected to be published on April 4. Therefore, individuals and companies still have four days to submit their written comments on the proposed regulatory agenda through the Participa + Brasil platform.


The public consultation was launched on February 10 during a press conference at the Ministry of Finance. Individuals, companies, and other stakeholders had two options to participate: express their opinions during the public hearing held on February 21 or submit written suggestions via the Participa + Brasil platform, available until Thursday.

Established on January 31, 2024, within the Ministry of Finance, SPA’s initial actions included the publication of Ordinance 561/2024, which set a regulatory agenda for fixed-odds betting for the previous year, aiming to launch the regulated market on January 1, 2025.

For the current biennium, the agenda includes significant changes. First, it incorporates topics under SPA’s responsibility that were left out in 2024, such as commercial promotions and the instant lottery (Lotex). The creation of a database of bettors excluded from gambling (by law or self-exclusion) is one of the first points on the agenda.

Another change is the introduction of public consultations, in accordance with Law 13.848/2019 and Decree 12.002/2024. These consultations will not only address the content of new regulations but will also determine which topics will be covered and in what order. In short, they will define the structure of the regulatory agenda. This phase is coming to an end.
