Finance Ministry and STF Review Brazil’s Betting Rules
Brazil.- 17 July 2026 www.zonadeazar.com Brazil’s Ministry of Finance and Supreme Federal Court met in Brasília to discuss the regulation, supervision and player protections governing the country’s betting market.
Finance Minister Dario Durigan met Edson Fachin, President of the Supreme Federal Court (STF), to present the measures adopted by the Government to regulate and oversee betting operators.
The meeting was intended to strengthen institutional dialogue between the Executive and Judiciary as the Court considers several cases involving Brazil’s Betting Law and regulations issued by the Ministry of Finance.
Legislation and more than 70 ordinances
Durigan presented documentation prepared by the Secretariat of Prizes and Betting covering legislation approved by Congress and more than 70 ordinances introduced to regulate and supervise the sector.
The measures address requirements for licensed operators, player protection, advertising, anti-money laundering controls, operational supervision and enforcement.
The Ministry has also supported tighter advertising restrictions, measures addressing player losses and stronger action against illegal betting platforms.
Cases before the STF
Fachin said the Supreme Court is expected to consider several cases concerning online betting regulation during the second half of 2026.
The proceedings examine the protection provided by Law 14,790/2023, the validity of regulatory measures and initiatives by states and municipalities to authorise or regulate betting platforms.
The cases are being handled by Justices Luiz Fux, Nunes Marques, André Mendonça and Cármen Lúcia.
Debate over land-based gambling
On 5 August, the STF is also expected to examine Extraordinary Appeal 966,177, concerning the constitutionality of Article 50 of Brazil’s Misdemeanours Act.
The provision establishes penalties for operating games of chance in public places. The ruling will be relevant to determining the legal position of land-based gambling in Brazil.
Fachin said future decisions would take into account the evidence gathered in the proceedings, public hearings and the regulatory measures implemented by the Government.
