Native Tribes Challenge Kalshi and Polymarket

According to Protos, tribal representatives argue that platforms such as Kalshi and Polymarket, together with certain interpretations adopted by the Commodity Futures Trading Commission (CFTC), could undermine existing tribal gaming agreements and reduce revenues that support healthcare, education, social services and economic development programs.

The filings are part of ongoing legal disputes regarding the legality of sports-related event contracts offered by prediction market operators. Tribal leaders maintain that these products should be regulated under existing state and tribal gaming frameworks.

The dispute comes as prediction markets continue to grow rapidly throughout the United States. While Kalshi and Polymarket expand their operations, several states, gaming organizations and tribal authorities have raised concerns regarding the impact of these platforms on established gambling regulations.

The debate also coincides with the CFTC’s ongoing public consultation on new prediction market regulations, a process that could significantly influence the future of the sector.
