Brazil Tightens Rules for Online Betting Advertising

The measures establish mandatory warning messages, prohibit the integration of sports analysis with betting promotion and expand the responsibilities of advertisers and digital platforms to protect minors.

Ordinance SPA/MF No. 1,964 requires every betting advertisement to include an approved warning from the Ministry of Finance. The available messages state that gambling causes financial losses, may lead to addiction or should not be treated as an investment.

The warnings must be displayed horizontally, remain clear and legible and occupy at least 10% of the advertisement’s size or length. The requirement will take effect on 17 July 2026.

Interministerial Ordinance MF/SECOM/MJSP No. 73, which took immediate effect, expressly prohibits combining sports analysis with betting advertising. This includes broadcasters, commentators or other participants recommending specific wagers or encouraging viewers to bet on an event.

The rules also classify as violations advertisements displaying winning bets, directing consumers to unauthorised operators through links or promotional codes, promising easy profits or portraying betting as evidence of personal, social or financial success. False, discriminatory or sexualised messages and advertising directed directly or indirectly at children and teenagers are also prohibited.

Advertisers and social media platforms must introduce measures preventing betting promotions from being delivered to accounts belonging to minors. The changes follow growing public pressure over the visibility of betting brands during sports broadcasts and digital content.

The debate intensified after criticism of betting promotions shown during World Cup broadcasts, where real-time odds and specific wagers were presented to audiences. The controversy triggered investigations and renewed demands for stricter advertising controls.

Operators, affiliates, media companies and digital platforms will need to review their campaigns, audiovisual formats and commercial agreements to comply with the new requirements. Breaches may be treated as violations of the rules established by the Secretariat of Prizes and Betting, increasing regulatory exposure across the advertising supply chain.
