Court Restricts Betting Ads by Virginia Fonseca and Blaze

Brazil.- 23 July 2026 www.zonadeazar.com The Court of Justice of the Federal District and Territories (TJDFT) has imposed restrictions on betting advertising promoted by influencer Virginia Fonseca and operator Blaze.

The ruling prohibits advertisements that promise fixed or guaranteed returns, portray betting as a source of income, investment, alternative to employment or solution to financial difficulties, or minimise and deny the risk of losses.

All betting promotions published by Fonseca must be clearly identified as advertising. The requirement covers stories, reels, social-media posts and live streams, including promotions incorporated into content about her personal routine.

The court gave the parties 48 hours to remove material that breaches the ruling. Each violation may result in a BRL100,000 penalty, initially capped at a combined BRL2 million.

The decision partially grants an appeal filed by the Public Prosecutor’s Office of the Federal District and Territories (MPDFT), which accuses Fonseca and Blaze of abusive and misleading advertising.

Industry Context

Judge Renato Rodovalho Scussel rejected, at this stage, the MPDFT’s request to suspend any possible remuneration agreement based on customer losses, commonly described as a revenue-share model. He found that there was not yet sufficient evidence regarding the alleged contractual structure.

The court also rejected the request to remove every betting-related publication. The order applies only to material that breaches the specific restrictions imposed.

The MPDFT has additionally requested compensation for bettors diagnosed with gambling addiction and up to BRL380 million in collective moral damages from Blaze.

Statements

Referring to a post in which Fonseca placed a bet without clearly identifying the commercial nature of the content, the MPDFT argued:

“The recipient does not process the message as explicit advertising; they internalise it as a personal gesture from someone they trust.”

The authority said this approach could transform a commercial action into a personal endorsement by exploiting the relationship of trust between a public figure and their audience.

Fonseca and Blaze must review and remove non-compliant content within the court-imposed deadline. Any financial penalties will depend on their compliance with the order.
