Brazil Reviews Betting Operator Licensing Rules

The process will gather proposals and information to support the drafting of new licensing regulations, incorporating lessons from the first authorisation cycle of Brazil’s regulated betting market.

The consultation was launched through Public Consultation Notice No. 3/2026 and will remain open for 45 days, from 27 July to 9 September 2026.
Individuals and legal entities may submit contributions through the Brasil Participativo platform. Participants are required to access the system using a gov.br account, while a separate registration route is available for foreign contributors.
The review will focus on the authorisation application procedure currently governed by SPA/MF Ordinance No. 827/2024, which established the conditions companies must meet to secure federal permission to operate fixed-odds betting and online gaming in Brazil.
Industry Context
The initiative forms part of the SPA Regulatory Agenda established in April 2025. That programme already included a review of the authorisation framework following the first stage of the regulated market’s implementation.
The consultation may lead to changes concerning required documentation, administrative procedures, assessment criteria and other conditions affecting operators entering or remaining within the federal system.
The review also coincides with a Ministry of Finance initiative to increase transparency across betting-licensing procedures. In June, the Government announced plans to publish more than 25,000 documents connected with authorisation applications.
The Ministry subsequently established a task force focused on ensuring greater transparency in licensing processes involving gambling companies.
Next Steps or Impact
Once the consultation period closes, the SPA will assess the submissions in accordance with the procedure established under Decree No. 12,002/2024.
The collected information will support the preparation of new regulations that may affect both future applicants and companies already holding federal authorisations.
For operators, the consultation provides an opportunity to propose changes covering application timelines, documentary requirements, corporate assessments and other elements of the licensing process.
