New Jersey Casinos Seek Prediction Market Restrictions

The submission also seeks to stop platforms from using their federal status to distribute these products in jurisdictions where sports betting remains prohibited.

Industry Context

Prediction markets allow participants to buy and sell contracts whose value depends on whether a future event occurs. In the United States, registered platforms operate under federal CFTC supervision and classify these products as financial derivatives rather than conventional wagers.

This interpretation has created conflict with state regulators and representatives of the licensed gambling industry. States argue that contracts based on matches and sporting competitions amount to betting and should therefore be subject to local licensing, taxation and consumer-protection rules.

The CFTC maintains that federal law grants it exclusive jurisdiction over registered event-contract markets. During 2026, the authority filed legal actions against several states attempting to apply their gambling laws to those platforms.

New Jersey had already attempted to prevent Kalshi from offering sports contracts in the state, but a federal court ruling temporarily blocked that enforcement action.

Regulatory Competition

The casino association believes that allowing sports contracts under a federal framework creates an uneven competitive environment for conventional sportsbooks.

State-licensed operators must obtain approvals, pay local taxes, contribute to responsible-gambling programmes and comply with territorial restrictions. Prediction market platforms may offer similar products under a different framework and potentially provide access across all 50 states.

The debate is particularly significant because of New Jersey’s historical role in the expansion of legal sports betting. The state led the litigation that resulted in the 2018 Supreme Court decision overturning the federal PASPA restriction and allowing each jurisdiction to determine whether to authorise wagering.

Sports betting has since become legal in 39 states and Washington, D.C., while prediction markets have rapidly expanded their range of contracts linked to sporting competitions and outcomes.

The CFTC is examining which types of event contracts may be contrary to the public interest and what additional obligations should apply to prediction markets. The process covers issues including sporting integrity, manipulation, inside information and participant protection.

A federal restriction on sports contracts could protect state regulatory authority and reduce direct competition with licensed sportsbooks. However, it would also represent a significant change for platforms that have built part of their recent growth around sport.

The eventual decision will help determine whether sports event contracts remain regulated federally as financial derivatives or must comply with the same state requirements applied to conventional betting.
